Gerber fails to get US antitrust claims over infant formula dismissed

US District Judge Nina Gershon denied Gerber’s motion to dismiss, finding that the amended complaint adequately makes out that “the acquisition was undertaken with the economic purpose and the effect of entrenching Perrigo’s market power at the expense of potential competitors.”See attached file. ...
