Gerber fails to get US antitrust claims over infant formula dismissed

( September 18, 2026, 19:33 GMT | Official Statement) -- MLex Summary: Formula distributor P&L Development has sufficiently alleged that Gerber’s sale of its only US infant formula plant in Wisconsin — from which Gerber used to supply PLD — to Perrigo increased barriers to enter the market for the sale of store-brand infant formula, according to a New York federal judge. US District Judge Nina Gershon denied Gerber’s motion to dismiss, finding that the amended complaint adequately makes out that “the acquisition was undertaken with the economic purpose and the effect of entrenching Perrigo’s market power at the expense of potential competitors.”See attached file. ...
