Japan proposes consent exceptions, biometric and children's data rules under amended law
( September 17, 2026, 01:11 GMT | Official Statement) -- MLex Summary: Japan’s privacy commission on Wednesday outlined its basic approach and key issues for implementation rules under the amended privacy law, due to take effect by July 2028.The amended Act on the Protection of Personal Information permits certain data uses without consent where individuals’ rights are unlikely to be infringed. The Personal Information Protection Commission proposed limiting the exception to cases in which an infringement is clearly unlikely, including where use is necessary for a contract. It also discussed rules on children’s and biometric data, including facial-recognition data, and plans to consult stakeholders on the scope of regulated biometric data and circumstances in which a legal guardian’s right to stop the use of a child’s data may be exempted.The statement is attached (in Japanese). ...
