South Korea’s antitrust regulator targets repeat disclosure offenders
( September 7, 2026, 07:05 GMT | Official Statement) -- MLex Summary: South Korea’s antitrust regulator is proposing tougher penalties for companies that repeatedly violate disclosure obligations applicable to designated business groups, as part of revisions aimed at strengthening compliance and enforcement. Under the proposed changes, repeat violations within the previous five years would trigger surcharges of 10 percent for one prior violation, 30 percent for two and 50 percent for three or more, replacing the current system under which surcharges begin only after four violations and are capped at 20 percent. The Korea Fair Trade Commission also plans to eliminate reductions based on short disclosure delays and first-time violations, as well as a cap limiting the basic fine for smaller companies to 1 percent of their capital or total equity. The proposed revisions will be open for public comment from Sept. 8 through Sept. 28 before the regulator finalizes them following further review and deliberation.Statement is attached (in Korean)....
