Garcia denied most of the companies’ motions to dismiss, finding that the allegations of "parallel conduct — reduced relative output of shale oil production — when read in combination with allegations addressing market structure, communications, common ownership, and anomalous output decisions," are sufficient to nudge the conspiracy claims from possible to plausible.
