The Korea Fair Trade Commission said the current single-calculation framework does not adequately reflect the seriousness or characteristics of noncompliance, while differences between the enforcement decree’s 50 percent adjustment limit and broader discretion under its guidelines have also created interpretive concerns. The study will examine the legal nature and calculation framework of the fines, review 28 merger-remedy decisions issued since 2016 and consider using transaction value for structural remedies and alternatives such as relevant sales, total sales or fixed amounts for behavioral remedies. The final report is due by Nov. 30 and may lead to revisions of the enforcement decree, guidelines or, if necessary, the Monopoly Regulation and Fair Trade Act.Notices are attached (in Korean)....
