Federal Wiretap Act claim against Blue Shield dismissed by US federal judge

( July 10, 2026, 22:27 GMT | Official Statement) -- MLex Summary: A US federal judge dismissed, with leave to amend, a proposed class action accusing Blue Shield of California of violating the federal Wiretap Act by embedding Google Analytics and Meta Pixel on its website. While US District Judge Yvonne Gonzalez Rogers found the alleged disclosure of personally identifiable medical information could be highly offensive and analogous to traditional privacy harms, the case nevertheless failed because the complaint attributed the interceptions to Google and Meta, not Blue Shield. She ruled that the Wiretap Act does not provide a private claim against a company merely for procuring, facilitating or aiding another party’s interception. The plaintiffs also did not adequately allege that Blue Shield itself unlawfully disclosed or used intercepted communications; their targeted-advertising allegations were vague and often suggested Google or Meta performed the alleged use.See attached....
