Express Scripts, others ask US court to hold appeal over FTC authority

( June 22, 2026, 22:18 GMT | Official Statement) -- MLex Summary: The Federal Trade Commission and Ascent Health Services, EverNorth Health, Express Scripts and Medco Health Solutions jointly asked a US appeals court to hold in abeyance a lawsuit bringing a constitutional challenge to the FTC's s adjudication of an administrative complaint. Oral argument in the case was held Nov. 19, parties told the US Court of Appeals for the Eighth Circuit. The parties have now jointly asked the court to hold the appeal in abeyance because the FTC is considering negotiated resolutions of the administrative proceedings that gave rise to the lawsuit. If the FTC approves those resolutions, the plaintiffs will dismiss the lawsuit. "In a series of steps over the past few months — the last of which occurred in recent days — the FTC has withdrawn from adjudication its complaint against all plaintiffs while it considers possible negotiated resolutions," the parties said in a filing. Considerations of judicial economy warrant an abeyance, they said.See attached document...
