In a filing to the US Court of Appeals for the Eleventh Circuit, the AG said that in the Texas case the Fifth Circuit observed that the statute “may not regulate speech at all, given that it does not target any substantive content but instead regulates commercial conduct with an incidental relationship to speech.”See attached file. ...
