OpenAI, Microsoft fail to scuttle Musk's US claims over for-profit conversion

( January 16, 2026, 01:00 GMT | Official Statement) -- MLex Summary: Elon Musk's allegations that OpenAI committed fraud and breach of charitable trust through its conversion from a non-profit to a for-profit model are going to trial, after a federal judge in California denied OpenAI's motions for summary judgment to throw out Musk's claims of unjust enrichment, constructive fraud, fraud, and breach of charitable trust. US District Judge Yvonne Gonzalez Rogers did narrow claims against Microsoft, however, granting its motion to throw out Musk's unjust-enrichment and tortious interference with contract class claim, but denying Microsoft's motion for summary judgement on Musk's claim of aiding and abetting breach of fiduciary duty.See attached document....
