Japan updates antitrust guidelines on price negotiations to reflect wage increases

The Cabinet Secretariat and the Japan Fair Trade Commission on Friday released the revised guidelines reflecting suppliers’ wage increases. Alongside wording changes linked to enforcement of the amended Subcontract Act — which renames subcontractors as small and medium-sized entrusted business operators — the guidelines clarify that unilaterally setting prices by refusing to negotiate with suppliers violates the revised law. The updated guidelines, revising those issued in November 2023, also emphasize the need to ensure price pass-through across supply chains and set out examples of good practices for specific industries.
