EU energy watchdog loses case on management of cross-border electricity markets

The judges at the EU's General Court annulled ACER’s decision imposing extra economic-efficiency tests for including internal network elements in capacity calculations. The court ruled that EU law only requires elements significantly affected by cross-zonal flows, finding ACER had exceeded its mandate.Press release and judgment attached.
