US appeals court denies CoStar rehearing on revive of CREXi's counterclaims

( September 5, 2025, 19:07 GMT | Official Statement) -- MLex Summary: A US appeals court amended its opinion reversing a federal district court's dismissal of CREXi's monopolization counterclaims against CoStar Group, denying the defendant a rehearing en banc on the decision. The US Court of Appeals for the Ninth Circuit found that CREXi's claims that CoStar monopolized the market for Internet CRE listings and auction services are plausibly alleged, specifically that CoStar "has monopoly power in the relevant markets and engaged in anticompetitive conduct by entering de facto exclusive agreements and constructing technical barriers." CREXi plausibly alleges that CoStar's agreements with brokers substantially foreclose competition, along with California Unfair Competition Law claims, but its tortious interference claims are dismissed "as they were improperly raised in CREXi's amended counterclaims," the order affirming in part and reversing in part said.
