Videographer can't pursue US DMCA claims against Netflix over docuseries

( April 2, 2025, 10:10 GMT | Official Statement) -- MLex Summary: US District Judge Andre Birotte Jr. of the Central District of California said that although plaintiff Corin Smith adequately pleads scienter he still cannot show a violation of Section 1202 of the Digital Millennium Copyright Act by Netflix and the Oceanic Preservation Society. At issue is audio-video footage Smith took and later licensed to Don Staniford, on a nonexclusive basis, of open cage salmon farming. Staniford had Smith’s permission to upload the audio-visual works to YouTube, alone, but they were later included in OPS's docuseries “You Are What You Eat: A Twin Experiment,” streamed on Netflix.
