FTC gets Illumina-Grail deal challenge dismissed without prejudice by US judge

By Michael Acton ( May 28, 2021, 23:31 GMT | Insight) -- Illumina and Grail today failed to convince a US judge that the Federal Trade Commission’s challenge to their planned deal should stay in court to prevent further administrative delays on top of the EU’s review of the deal. Judge Cathy Ann Bencivengo said Illumina and Grail failed to show they would suffer legal prejudice if the case is dismissed with an opportunity for the FTC to return again at a later date, and she dismissed the case without prejudice – despite warnings from Illumina’s lawyer that the FTC was attempting to “scuttle” the deal by “procedural maneuver.” Illumina and Grail today failed to convince a US judge that the Federal Trade Commission’s challenge to their planned deal should stay in court to prevent further administrative delays on top of the European Union’s review of the deal....
