BMW, Volkswagen, Daimler get off antitrust case

( October 23, 2020, 22:31 GMT | Official Statement) -- MLex Summary: BMW, Volkswagen, and Daimler have won the dismissal of claims that they conspired to fix the prices of German diesel cars. US District Judge Charles R. Breyer dismissed indirect purchasers’ claims, saying, “Beyond bare allegations and 'empirical evidence' of no value, IPPs have alleged nothing to contradict the commonsense inference that diesel passenger vehicles compete with other passenger vehicles and do not constitute a relevant submarket.” Additionally, Breyer determined that direct purchasers have not plausibly alleged either that the companies’ agreement to accept the steel manufacturers’ prices resulted in higher steel prices, resulting in harm to competition in a relevant market, or that they agreed to pass-through increased steel costs to direct purchasers.
