US FTC's Khan, Slaugther, Bedoya defend noncompete ban, rulemaking authority

( December 31, 2024, 21:47 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission's final rule banning noncompete agreements across the country reflects a lawful delegation by Congress that doesn't invoke the US Supreme Court's "major questions" doctrine, and the commission has authority to promulgate the rule "based on the plain text of the FTC Act, case law and statutory history," agency Chair Lina Khan and Commissioners Rebecca Kelly Slaughter and Alvaro Bedoya said in a statement. Republican FTC Commissioners Melissa Holyoak and Andrew Ferguson "might prefer that the Commission analyze noncompetes through the prism of the Sherman Act, but faithfully administering the FTC Act requires that we honor — rather than collapse — their differences," the statement said....
