Challenge to Sisvel-backed patent's amended claims reinstated by US court

By Melissa Ritti ( February 3, 2025, 19:56 GMT | Insight) -- The US Patent and Trademark Office’s Patent Trial and Appeal Board wrongly ruled that a series of challengers to a 3G Licensing patent failed to prove various independent and dependent substitute claims are unpatentable. Writing today for the US Court of Appeals for the Federal Circuit, US Circuit Judge Kimberly Moore agreed with Telit Cinterion Deutschland GmbH, Honeywell, Sierra Wireless, TCL Communication, TCT Mobile and various TCT affiliates that because the steps of 3G’s claimed method are not in order, they lack written description support.Proposed amendments to a method patent by 3G Licensing, the now defunct manager of the Sisvel 3G pool, must be given a second look, the US Court of Appeals for the Federal Circuit ruled today....
