NVIDIA's bid to change language of UPC proceedings rejected

( January 17, 2025, 10:16 GMT | Official Statement) -- MLex Summary: NVIDIA's application to change the language of its Unified Patent Court proceedings against ParTec and BF exaQC was dismissed. The Munich Local Division found that ParTec and BF exaQC’s choice to conduct proceedings in German was reasonable, given that three of the four parties involved are based in Germany and the companies operate predominantly in German. The court found NVIDIA's argument that conducting proceedings in English would reduce translation efforts insufficient to override ParTec and BF exaQC’s right to proceed in their chosen language. While acknowledging that English is the common language in the field of computer technology, the court emphasized under Article 49(5) of the UPC Agreement, the court must consider the parties' sizes, domicile, and ability to participate in proceedings without undue burden. The case concerns alleged infringement of ParTec's European Patent 3,743,812 and European Patent 2,628,080 relating to computing technologies. ParTec and BF exaQC initiated the claim in October against NVIDIA Corporation and and its German subsidiary.See court document attached....
