Trader Joe’s trademark case cited as basis to stay claims against nurse’s union

In a text order entered today, US Judge Mae A. D'Agostino of the Northern District of New York put the case on hold until the US Court of Appeals for the Ninth Circuit issues its decision in a similar dispute between Trader Joe’s Company and Trader Joe’s United. Both actions raise thorny issues about the ability of federal courts to intervene when intellectual property protections collide with collective bargaining.The viability of trademark infringement claims leveled against a labor union representing 40,000 nurses in New York state could hinge on the fate of Trader Joe’s workers accused of using the “Trader Joe’s” trademark without the consent of their employer....
