Getty faces high hurdles in maintaining UK class claims against Stability AI

( January 14, 2025, 13:44 GMT | Official Statement) -- MLex Summary: UK High Court Judge Joanna Smith rejected efforts by a US photographer and his company, whose content is exclusively licensed to Getty Images, to serve as the "Sixth Claimant" in Getty's purported class action against Stability AI. The ruling dealt a blow to Thomas Barwick and Thomas Barwick Inc., who sought to represent all owners of copyrights in artistic works and film works licensed exclusively to Getty and infringed by Stability AI’s training of Stable Diffusion. Smith foreshadowed continued woes for Getty in her ruling, however, deeming it "imperative that the parties now seek to resolve, as quickly as possible, the serious case management issues that have been exposed by the making of" Barwick's application and urging the parties to "find a way of taking this case forward to the First Trial in June on the basis of a realistic and manageable set of issues."See attached document....
