UPC finds jurisdiction, says corporate veil piercing is a matter for merits

( December 19, 2024, 16:57 GMT | Official Statement) -- MLex Summary: The Unified Patent Court has rejected an early challenge to jurisdiction by an individual defendant, in a case concerning EP 3,918,974 held by Visibly Inc. The Hamburg Local Division ruled that the question of whether the court can hold the director of a corporation personally liable — a practice known as piercing the corporate veil — is within the UPC's jurisdiction, but “is an assessment that belongs to the decision on the merits” in the infringement case. Defendants Yves Prevoo and Easee Holding BV had argued that the UPC lacked jurisdiction over their liability, as the claims against them were based on tort, and not on co-defendant Easee BV's alleged direct patent infringement. The UPC said that jurisdictional issues should not be conflated with the merits of the case.See court document attached....
