Stage set for binding, advisory jury verdicts at US trial over military marks

( December 13, 2024, 10:10 GMT | Official Statement) -- MLex Summary: A US judge in Texas said that a jury empaneled in February 2025 will be asked to issue two verdicts — one binding, one advisory — in a dispute between Shields of Strength and the US Department of Defense. According to the court, because Shields of Strength’s original complaint contained a jury demand, that same jury demand holds for the DoD’s later leveled counterclaims even though Shields of Strength is not entitled to a jury trial of its own. Earlier this year, US District Judge J. Campbell Barker of the Eastern District of Texas said Shields of Strength's noninfringement declaratory judgment claim falls outside the Administrative Procedure Act’s waiver of sovereign immunity....
