Vintage Brand co-defendant Sportswear Inc. seeks early exit from Penn State trial

( November 14, 2024, 10:10 GMT | Official Statement) -- MLex Summary: Sportswear Inc. seeks judgment as a matter of law that it does not directly infringe trademarks belonging to the Pennsylvania State University. Trial between the parties began Nov. 12.  According to Sportswear, the university “has not adduced even a scintilla of evidence that the designs printed on the front-center of apparel — and in similarly ornamental manners on other goods — serve the ends of trademark law.” “Instead,” the defendant's motion continued, “the University is openly seeking to leverage its ‘trademarks’ as economic awards that it deserves to monetize for reasons entirely divorced from the source-identifying rationale behind trademark protection.” See attached file...
