Comment: GDPR damages claims are easier after EU court ruling, but don't expect a flood

By Matthew Newman ( May 4, 2023, 16:44 GMT | Comment) -- While the EU’s top court has made it easier for individuals to file damages case for GDPR violations by declining to set a threshold for the “seriousness” of non-material damages — such as pain, upset or stress —  don't expect a flood of new cases to hit national courts. Today's ruling pleased privacy activists, but the judgment’s impact is expected to be limited to cases in Austria and Germany, where courts have previously imposed a threshold for non-material damages.Europe's courts are unlikely to be flooded with new compensation claims stemming from violations of the EU’s landmark data protection law after the bloc’s top judges today left it for them to judge the “seriousness” of damage....
