US SEC's use of no-admit-no-deny settlements goes against spirit of First Amendment, federal judge says

( October 28, 2022, 21:13 GMT | Official Statement) -- MLex Summary: The US Securities and Exchange Commission’s practice of demanding that defendants waive their right to ever deny the allegations against them is “inconsistent with the spirit of the First Amendment” and the protection of free expression, according to a federal judge. US District Judge Ronnie Abrams approved "with reluctance" the agency’s consent decree with Fernando M. Moraes, saying that the fact that defendants may waive their First Amendment rights does not mean that the government should be in the business of demanding that they do so. “What is the SEC so afraid of? Any criticism, apparently—or, rather, anything that may even 'create the impression' of criticism—of that governmental agency,” Moraes wrote in his opinion.See document below. ...
