Modafinil pay-for-delay fine: summary decision, hearing officer's report published by EU

( January 29, 2021, 09:12 GMT | Official Statement) -- MLex Summary: The European Commission today issued a summary version of its decision last year to fine pharmaceutical companies Teva and Cephalon 60.5 million euros for delaying market entry for several years of a cheaper generic version of modafinil, a Cephalon drug used for sleep disorders. Cephalon induced Teva not to enter the market with a cheaper version of the drug, in exchange for a package of side-deals and cash payments to the benefit of Teva, the commission said in November. Alongside the publication of the text of the decision, the commission also released the final report of the hearing officer.
