( January 18, 2012, 21:22 GMT | Official Statement) -- MLex Summary: U.S. District Court Judge Susan Illston has issued an order granting in part and denying in part the defendants' joint motion to dismiss Office Depot's price-fixing claims and NEC's individual motion to dismiss. Illston ruled that Office Depot's claims under Florida law may continue, but its claims under California law are barred by the statute of limitations and because the fact that all relevant transactions took place in Florida would make it a due process violation to apply California law. Illston denied the defendants' request to enforce a contractual jury trial waiver because it should not apply retroactively, and found no problem with Office Depot's use of a group pleading....
