Belgium must revise draft data retention law, data protection authority says

( July 8, 2021, 09:51 GMT | Official Statement) -- MLex Summary: The Belgian Data Protection Authority has told the government in an opinion that it should review a draft data retention law before it is submitted to the Belgian parliament, to ensure conformity with EU case law. Belgium must revamp the law after it was annulled by the country's Constitutional Court in April. The authority said the draft law should conform with the EU Court of Justice's ruling in October 2020 that prohibits EU member states from imposing rules on telecom companies that require the general and indiscriminate storage of traffic and location data, except in cases of serious threats to national security. The authority said the draft law must balance the fundamental rights to security and the respect for private life and the protection of personal data.The opinion is attached....
