GSK urges Third Circuit to block Louisiana antitrust case over Flonase

( October 26, 2016, 22:31 GMT | Official Statement) -- MLex Summary: GlaxoSmithKline has filed an opening brief in its appeal of a decision that allowed the state of Louisiana to bring allegations that the drugmaker delayed the market entry of generic Flonase. GSK says that sovereign does not immunize the state from a settlement to which it was a party. “Sovereign immunity does not apply when, as here, the state is aligned solely as a plaintiff, i.e., no one asserts any claim against the state,” wrote GSK. See document below. ...
