Attorneys general from 19 states oppose US FTC ban on noncompete agreements

( April 19, 2023, 22:31 GMT | Official Statement) -- MLex Summary: A group of 19 state attorneys general wrote to oppose the US Federal Trade Commission’s proposed ban on noncompete clauses, arguing that the issue cannot be addressed by a one-size-fits-all solution. “The Proposed Rule erases the lessons learned from thousands of state law cases decided over hundreds of years in favor of a single economy-wide regulatory experiment […] State flexibility matters, especially in an area where tailored solutions can better reflect difficult-to-balance policy needs,” they wrote. The attorneys general argued that the commission lacks statutory authority to issue the rule, the rule would raise serious constitutional concerns, and the rule does not reflect reasoned decision-making.See document below. ...
