FIFA, US Soccer ask US appeals court to rehear antitrust suit

( April 4, 2023, 22:31 GMT | Official Statement) -- MLex Summary: The Fédération International de Football Association and US Soccer Federation asked a US appeals court to rehear Relevent Sports’ antitrust claims over a policy prohibiting any league or team from playing an official-season game outside its home country. The Court of Appeals for the Second Circuit reversed a dismissal order in March. “In sweeping fashion, the panel in this case held that the critical threshold element of ‘concerted action’ is automatically satisfied as to all of an association’s members merely by alleging that a policy promulgated by the association violates the antitrust laws,” they said. “That holding eradicates the requirements this court has previously imposed on pleading concerted action in this context, conflicts with the decisions of other circuits, and violates long-standing principles of antitrust law and pleading requirements.”See document below. ...
