Barclays isn’t barred by EU law from enforcing Spanish mortgage, EU court rules

( April 30, 2014, 09:27 GMT | Official Statement) -- MLex Summary: EU law doesn’t preclude Barclays from seeking to collect a debt remaining after the auction of the borrower’s foreclosed home fell short of the balance of the mortgage, the EU’s top court ruled. The arrangement contested by the borrower is determined under Spanish law, not the terms of the mortgage agreement, so the EU directive on unfair contract terms doesn’t apply, the judges in Luxembourg said.See the full text of the judgment in C-280/13 Barclays Bank attached below....
