Judge dismisses complaint by indirect purchasers in Lidoderm suit, leaves other claims standing

( July 18, 2015, 22:31 GMT | Official Statement) -- MLex Summary: US District Judge William Orrick has partially granted a motion by Endo Pharmaceuticals and other drug companies who are defendants in a class action lawsuit over the drug Lidoderm, dismissing claims brought by a  group of indirect purchaser retailers known collectively as the “Walgreen Plaintiffs.” "The Walgreen Plaintiffs do not have standing to bring claims on their own behalf as indirect purchasers and have not adequately pleaded that they are entitled to injunctive relief. That portion of their claims is STRUCK," Orrick wrote in an order late Friday. "The remainder of defendants’ motion is DENIED. The assignments of the right to bring antitrust claims are valid and the partial assignment of claims does not require me to dismiss or stay the Walgreen Plaintiffs’ claims at this stage of the litigation." Please see attached order...
