Judge says reasonable suspicion, but not warrants, required for searches of electronic devices at border

( November 12, 2019, 22:31 GMT | Official Statement) -- MLex Summary: US District Judge Denise J. Casper has partially granted plaintiffs request for summary judgment on their Fourth Amendment claim in a case over the US government’s seizure of electronic devices at borders with the intent to search. Casper determined that reasonable suspicion, but not probable cause, is required for such searches. Casper granted the motion as to claims based on seizures with the intent to search after owners left the border. Casper said, “Where border agents seize an electronic device for non-cursory search supported by reasonable suspicion, such detention must be for a reasonable period that allows for an investigatory search for contraband.” The remainder of plaintiffs’ motion and all of the government’s motion were denied.See document below....
