They opposed setting aside their antitrust claims to discuss settlement, saying that the last-minute settlement fails even to meet the conditions set forth in the FTC notice of contemplated relief and proposed order. The companies’ proposed agreement would prohibit any future non-compete agreements between them without FTC permission, but the FTC proposal would stop any such agreement or e-cigarette transaction between them and other competitors.See document below. ...
