Tencent says California appeals court must reverse trial court and send WeChat privacy case to arbitration

( November 28, 2022, 23:27 GMT | Official Statement) -- MLex Summary: Tencent America told a California appeals court that its contract with WeChat users require disputes to be heard through arbitration, and that a trial court judge in Santa Clara County was incorrect to rule otherwise. "In the trial court, Plaintiffs primarily sought to avoid their obligation to arbitrate by arguing that their claims 'are too important and too intertwined with public policy and Constitutional interests for them to be decided by a private arbitrator',” Tencent told the California Sixth Appellate District. "Now on appeal, Plaintiffs double down on this meritless contention. Running through all of their arguments is the flawed assertion that this Court should create a novel exception for their case — and their case alone — because 'the factual allegations here are so extreme, unprecedented, sui generis, and politically sensitive'."See attached document....
