Judge keeps antitrust case over ceiling tiles alive

Kearney has denied Armstrong World Industries’ motion to dismiss claims that it unlawfully monopolized the insulation and ceiling systems market. Kearney determined that Roxul adequately pleaded Armstrong's exclusivity arrangements in the US suspended acoustical ceiling tile market violate the Sherman Act and Clayton Act. Kearney did dismiss Roxul's claim based on foreign trade in Canada and its claim for tortious interference without prejudice.See document below....
