Deutz, Diesel Motor Nordic successfully challenge Danish antitrust decision on supply of train spares

( February 27, 2023, 15:05 GMT | Official Statement) -- MLex Summary: Denmark's eastern high court has overruled parts of a 2013 antitrust decision, which found that Deutz had abused its dominant position by refusing to supply spare parts for train engines to Fleco via its dealer network. Deutz and Diesel Motor Nordic had jointly made an anticompetitive agreement to prevent Fleco from importing the spares, the authority decided. Its decision was initially confirmed by the Maritime and Commercial Court in 2021. On appeal, judges at the high court ruled that the regulator's market definition and the assessment of whether Deutz held a dominant position was flawed. The watchdog also failed to consider whether the restrictive behavior could have been exempted under current vertical group exemption rules.
