US government says that courts should not override agencies' administrative schemes

( August 8, 2022, 22:31 GMT | Official Statement) -- MLex Summary: Parties may not evade the administrative schemes of the US Securities Exchange Commission and the Federal Trade Commission for judicial review of orders issues by the commissions by suing the agencies in district court, the government told the Supreme Court. “[W]hen Congress enacts a remedial scheme, as it has in the FTC Act and Exchange Act, federal courts should not override the scheme’s limits by devising a substitute equitable remedy,” the government’s brief argued.
