PhRMA says order in FTC case over AndroGel goes too far

( June 12, 2019, 20:31 GMT | Official Statement) -- MLex Summary: The Pharmaceutical Research and Manufacturers of America has filed an amicus brief urging the US Court of Appeals for the Third Circuit to find that AbbVie, Abbott Laboratories, Unimed Pharmaceuticals and Besins Healthcare did not engage in sham patent litigation related to the drug AndroGel. PhRMA says the district court’s analysis constitutes a drastic expansion of the sham litigation exception to the Noerr-Pennington doctrine, and conflicts with the Supreme Court’s narrow articulation of the exception. “Adoption of the district court’s reasoning would undermine the robust patent protections that are critical to innovation in the biopharmaceutical industry, and could have serious negative consequences for scientific progress, public health, and the economy.”See document below....
