Chiropractor seeks panel rehearing of Fourth Circuit decision in antitrust suit against Virginia Board of Medicine

( May 31, 2016, 22:31 GMT | Official Statement) -- MLex Summary: Yvoune Petrie has petitioned the US Court of Appeals for the Fourth Circuit to rehear an order affirming summary judgment in favor of the Virginia Board of Medicine in her suit accusing it of violating Section 1 of the Sherman Act. The petition argues that the board was not subject to active supervision as required by the Supreme Court for state action immunity to apply, and that the Supreme Court also held that a solo class representative can bring a Sherman Act claim and that the representative does not have to demonstrate damages to a class. See document below....
