General Court: Order in T-40/08 European Renewable Energies Federation v Commission

( December 7, 2009, 13:15 GMT | Official Statement) -- MLex Summary: The General Court of the EU has dismissed as inadmissible an action brought by the European Renewable Energies Federation (EREF) against a European Commission decision which approved financial measures implemented by France for Areva's construction of a nuclear power plant for Teollisuuden Voima. The court has ruled that the applicant did not comply with Article 19 of the Statute of the Court of Justice which requires non-privileged parties to be represented by an external lawyer before the courts. In the current case, EREF’s action was lodged by its designated director Ms Fouquet in her capacity as a lawyer on behalf of the organisation. Nevertheless, the court did not consider EREF's director to be a lawyer acting as a third, independent party.Read the full order below....
