Court of Justice Statement: Judgment in Case C-403/10 P Mediaset SpA v Commission

( July 28, 2011, 09:38 GMT | Official Statement) -- MLex Summary: The EU Court of Justice has upheld decisions by the European Commission and General Court that subsidies to purchase TV decoders for digital terrestrial broadcasting in 2004 and 2005 were illegal state aid. The court found that the aid lowered the cost to broadcasters such as Mediaset – to the detriment of satellite broadcasters such as Sky – and should have been classified as illegal indirect aid. The court also confirmed that the commission did not have to fix the exact sum of the aid to be recovered, instead leaving that to national courts.The full statement follows:...
