South Korean competition regulator to introduce procedures for document requests and viewing for defendants

( November 2, 2020, 08:47 GMT | Official Statement) -- MLex Summary: Defendants in an antitrust investigation by the Korea Fair Trade Commission will be able to make an official request to view undisclosed information, under a set of procedures introduced by the competition regulator in an effort to protect the rights of defendants. The upcoming revision to the guidelines for investigation proceedings will enable defendants to submit a request to view information not revealed in an examiner’s report and mandate the regulator to review the request and inform data providers to seek their consent and decide within 30 days from the date of request. The regulator will also introduce a data-room procedure under which defendants can view business secrets or confidential information in a restricted setting, similar to the document-viewing procedure by the European Commission competition authorities.
