Judge refuses to certify class in cranberry antitrust case

Zobel has denied cranberry growers’ request for class certification in their case alleging Ocean Spray Cranberries unlawfully suppressed the market price of cranberry concentrate. Zobel found that plaintiffs failed to show that class litigation would be efficient, saying that their proposed class definition “requires individualized inquiries of each grower to determine, as to each, whether or not that grower belongs to the class” and that several potential class members are opposed to the goals of the class. See document below. ...
