Samsung says its US claims of anticompetitive tying against Broadcom over smartphone components not time-barred

( October 14, 2024, 19:49 GMT | Official Statement) -- MLex Summary: Samsung told a US federal court its claims of anticompetitive tying over critical smartphone components are not time-barred by the four-year statutes of limitations of the Sherman Act, Clayton Act, and Caifornia's Cartwright Act. In a filing to the US Northern District of California opposing Broadcom's motion to dismiss the complaint, Samsung said its claims did not accrue when it signed the "Strategic Agreement" in March 2020. The limitations began to run when Samsung was injured, not when it signed the strategic agreement. "Broadcom cites no case holding that a plaintiff is injured by the mere act of signing an agreement, and there is no such case," Samsung said. Even if limitations began to run outside the limitations period, Samsung can sue for injury within the limitations period, it said. Samsung said it has also adequately alleged injury-in-fact and harm to competition.See document below....
