Japan's new antitrust bill to regulate mobile ecosystems approved by cabinet for parliamentary submission

( April 26, 2024, 03:19 GMT | Official Statement) -- MLex Summary: A new bill to regulate anti-competitive behavior by smartphone ecosystem operators was approved by Prime Minister Fumio Kishida's cabinet today for parliamentary debate. The new bill, which will be submitted to parliament by the Japan Fair Trade Commission, is an ex-ante antitrust law to be applied to designated mobile OS operators, app stores, browsers and search engines. The designated companies will be prohibited from restricting third-party app store access and payment systems, setting their services as default without providing easy access to alternatives, self-preferencing, using data they acquired from third-party apps for their own advantage, or restricting functions on third party apps available on their operating systems. The companies subjected to the new law, to be designated within six months of parliamentary approval, will be fined 20 percent of their domestic sales, with a maximum fine of 30 percent for repeat offenses.
