Epic Games made 'sufficient preliminary showing' that Apple practices may undermine spirit of injunction in antitrust case, US judge says

( April 23, 2024, 23:00 GMT | Official Statement) -- MLex Summary: Epic Games and Apple will face off at an evidentiary hearing in May that could take place over three days over whether Apple is complying with a US court injunction that forced the smartphone maker to relax its anti-steering provisions for app developers. In an order setting the evidentiary hearing, US District Judge Yvonne Gonzalez Rogers of the Northern District of California wrote that Epic "has made a sufficient preliminary showing that, viewed holistically, Apple’s practice changes undermine the spirit of the injunction by limiting competition, impeding the free flow of information, and constraining user choice." She said the evidentiary hearing will be held on May 8 and that to the extent proceedings have not concluded, they shall resume on May 10 and again on May 17. The hearing for the dispute originally scheduled for April 30 was vacated. See document below. ...
