Questions in Spanish damages claim against Volvo published by EU Court

( January 23, 2023, 11:52 GMT | Official Statement) -- MLex Summary: EU judges have been asked for guidance in a Spanish antitrust damages claim against a Spanish subsidiary of truck-cartel member Volvo filed by transport company Transsaqui. The Spanish court overseeing the case issued a request to parent Volvo to defend itself against the claim, but this was sent to the address of the Spanish subsidiary. The Swedish truckmaker argues it should have received the court papers in Sweden. The Spanish court now wants to know, in the case of a damages action brought in one EU state against a parent company in another, if legal documents relating to the case can be considered as properly delivered if sent to the address of a subsidiary in that state where the action was brought.Press release follows....
