New trial in US Airways-Sabre case ordered by Second Circuit

( September 11, 2019, 14:01 GMT | Official Statement) -- MLex Summary: The US Court of Appeals for the Second Circuit has vacated a $15 million jury verdict against Sabre in an antitrust case it filed by US Airways, saying that in a case involving two-sided transaction platforms like Sabre the jury should be instructed that the relevant market must include both sides of the platform as a matter of law. The panel also determined that the district court erroneously dismissed US Airways’ monopolization claims against Sabre, finding that it adequately alleged a Sabre travel agent sub‐market. It affirmed the limitation of US Airways’ damages to those arising out of its 2011 contract with Sabre and prior to the execution of a 2012 settlement agreement.See document below....
